Terms & Conditions of Use
1. Agreement to These Terms
These Terms & Conditions of Use (“Terms”) govern your access to and use of theyongtrades.com and all related dashboards, alerts, applications, content, subscriptions, trial access, paper-trading tools, scoring systems, watchlists, charts, and services offered by The Yong Trades (collectively, the “Services”).
By creating an account, purchasing or starting a pass or trial, clicking to accept these Terms, or accessing the Services, you agree to be bound by these Terms, the Privacy Policy, the Disclaimer, and any additional terms presented for a particular feature. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old, have legal capacity to enter into a binding contract, and be permitted to use the Services under the laws of your location. You may not use the Services for another person who is not eligible or to evade legal, regulatory, broker, exchange, or market-data restrictions.
3. Accounts and Administrator Activation
You must provide accurate, current, and complete registration information and keep it updated.
Access may require administrator review or activation. Registration does not guarantee approval or immediate access.
You are responsible for safeguarding your password, authentication methods, devices, and account activity. You may not share, resell, rent, transfer, or sublicense account access unless we expressly authorize it in writing.
Notify us promptly at support@theyongtrades.com if you suspect unauthorized access, credential compromise, or account misuse.
We may require identity, payment, fraud-prevention, eligibility, or security verification before activating or continuing an account.
4. Services and Feature Availability
The Services may include real-time or near-real-time signals; strategy-based alerts using EMA, stochastic, RSI, ADX, MACD, VWAP, engulfing, momentum, and other methods; desktop, browser, email, or mobile alerts; proprietary scores for scalp, intraday, swing, and other horizons; top or active ticker rankings; paper trading; historical data and signal review; watchlists for stocks, forex, futures, cryptocurrencies, and altcoins; and multi-timeframe dashboards and charts.
Features, markets, symbols, data sources, strategies, scores, entitlements, and interfaces may be added, modified, limited, suspended, or discontinued at any time. Screenshots, demonstrations, and feature descriptions may show functionality that is not available for every symbol, venue, device, location, or period.
5. Subscriptions, Trading Passes, and Trial Access
The Yong Trades may offer time-limited passes, subscriptions, promotional access, or a free trial. The duration, price, included features, activation time, and renewal status shown at checkout or in an order confirmation form part of these Terms.
A pass or trial begins at the time stated during checkout, activation, or confirmation—not necessarily when you first log in.
Unless checkout clearly states that a plan renews automatically, a time-limited pass expires at the end of its stated access period. If automatic renewal is offered, the price, billing frequency, cancellation method, and required renewal disclosures will be shown before purchase.
A free trial may be limited to one per person, household, device, payment method, or other reasonable identifier. We may deny or terminate a trial where we reasonably suspect duplicate, fraudulent, abusive, or unauthorized use.
Promotional pricing, coupons, and trial offers may be changed or withdrawn before purchase and may not be combined unless expressly stated.
Taxes, payment-processing charges, currency conversion costs, bank fees, and third-party charges may apply as disclosed by the applicable provider.
6. Payment Authorization
By submitting a payment method, you represent that you are authorized to use it and authorize the applicable payment processor to charge the displayed amount, taxes, and any properly disclosed recurring charges. Payment processing is subject to the payment provider’s terms and privacy policy. We may suspend or withhold access for failed, reversed, disputed, fraudulent, or unauthorized payments.
7. Cancellations and Refunds
Because access may be provided immediately and the Services consist primarily of digital content and time-limited access, purchases are non-refundable except where required by law or where a refund policy displayed at checkout expressly provides otherwise. This sentence must be conformed to the business’s actual policy and applicable state consumer law before publication.
Canceling an automatically renewing plan, if offered, stops future renewals but ordinarily does not retroactively refund the current billing period. Account suspension or termination for a violation of these Terms does not create a right to a refund, except where required by law.
8. Educational and Informational Nature of the Services
The Services are general educational and informational tools. They are not personalized investment, legal, tax, or accounting advice. The Yong Trades does not guarantee any outcome, profit, income, win rate, signal accuracy, or avoidance of loss. You are solely responsible for deciding whether and how to trade, invest, or use information from the Services. The separate Disclaimer is incorporated into these Terms by reference.
9. Market Data and Alerts
Market data may originate from third-party vendors, exchanges, brokers, public sources, or licensed feeds and may be delayed, adjusted, corrected, unavailable, or subject to entitlement restrictions.
Alerts can fail, arrive late, be duplicated, or be affected by settings, connectivity, vendor outages, device restrictions, and other factors.
You must independently verify prices, market status, liquidity, contract terms, expiration, spreads, fees, and order details before taking action.
The Services are not an order-entry system unless a separate written integration expressly says otherwise. The Yong Trades does not monitor your brokerage account or positions.
10. Paper Trading and Historical Information
Paper trading, backtests, signal histories, and hypothetical examples are simulations and may differ materially from live execution. They may omit or estimate spreads, commissions, slippage, partial fills, liquidity, market impact, borrowing costs, funding rates, taxes, latency, and other real-world factors. Historical and hypothetical performance does not guarantee future results.
11. Acceptable Use
You agree not to:
Use the Services in violation of law, regulation, exchange rules, data-vendor terms, sanctions, or third-party rights.
Copy, scrape, crawl, harvest, index, record, republish, redistribute, sell, sublicense, broadcast, or commercially exploit the Services, market data, alerts, scores, watchlists, screenshots, or content except as expressly authorized in writing.
Use bots, scripts, automated queries, browser automation, or other methods that impose an unreasonable load, bypass limits, or extract data at scale.
Reverse engineer, decompile, disassemble, discover source code, derive models or scoring formulas, circumvent access controls, or attempt to defeat security or licensing restrictions.
Share credentials or provide account access to multiple users through a single-user plan.
Interfere with the Services, introduce malware, probe vulnerabilities, conduct unauthorized testing, or access another user’s account or data.
Misrepresent an affiliation with The Yong Trades or use our name, branding, signals, or content to promote a fraudulent, misleading, or guaranteed-return offering.
Use the Services to manipulate markets, coordinate unlawful trading, or engage in deceptive conduct.
12. Intellectual Property
The Services and their software, design, dashboards, branding, logos, text, graphics, organization, alerts, scoring methods, strategy configurations, watchlists, and other content are owned by or licensed to The Yong Trades and are protected by intellectual-property and other laws. Subject to these Terms and payment of applicable fees, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Services for your own lawful, non-commercial purposes during your authorized access period.
No right is granted to reproduce, distribute, publicly display, create derivative works from, train an artificial-intelligence model on, or commercially exploit the Services or content without prior written permission.
13. User Content and Feedback
You retain ownership of content you submit, such as support messages, feedback, or configuration information. You grant us a non-exclusive license to host, process, reproduce, and use that content as reasonably necessary to provide, secure, support, and improve the Services. You represent that you have the rights needed to submit it and that it does not violate law or third-party rights.
If you provide ideas, suggestions, or feedback, we may use them without restriction or compensation, provided we do not publicly identify you without permission.
14. Third-Party Services
Third-party websites, charts, brokers, exchanges, applications, payment systems, data feeds, or communication providers may be linked to or integrated with the Services. We do not control and are not responsible for third-party services, including their availability, accuracy, execution, pricing, privacy, security, or terms. Your relationship with a third party is governed by your agreement with that party.
15. Suspension and Termination
We may suspend, restrict, or terminate access when reasonably necessary to protect the Services or users; investigate fraud, security issues, payment disputes, or violations; comply with law or third-party requirements; address abuse or excessive automated usage; or discontinue a feature or the Services. Where reasonably practicable, we may provide notice and an opportunity to cure, but immediate action may be taken for security, fraud, legal, or material misuse concerns.
Upon termination or expiration, your right to use the Services ends. Provisions that by their nature should survive—including payment obligations, intellectual property, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.
16. Service Changes, Maintenance, and Availability
We may perform maintenance or updates and may experience outages, delays, interruptions, data errors, or feature limitations. We do not promise a specific uptime, latency, delivery time, retention period, or level of support unless expressly stated in a separate written service-level agreement.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE YONG TRADES DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, AND THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE YONG TRADES AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY; TRADING OR INVESTMENT LOSSES; MISSED OR DELAYED ALERTS; OR LOSSES ARISING FROM THIRD-PARTY SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE YONG TRADES FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) US$100. THIS LIMIT SHOULD BE REVIEWED BY COUNSEL FOR ENFORCEABILITY AND CONSISTENCY WITH THE BUSINESS MODEL.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Yong Trades and its owners, officers, employees, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, infringement of third-party rights, or misuse of data or account access. This obligation does not apply to the extent a claim results from conduct for which indemnification cannot lawfully be required.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where the law of your residence requires otherwise. Before filing a legal claim, you and The Yong Trades agree to attempt in good faith to resolve the dispute by sending a written notice describing the issue and requested resolution to support@theyongtrades.com and allowing 30 days for a response.
Any court proceeding that is not resolved informally will be brought in a state or federal court of competent jurisdiction located in [INSERT COUNTY], Texas, unless applicable law requires another venue. Each party consents to personal jurisdiction and venue in those courts. This section should be completed and approved by counsel before publication.
21. Changes to These Terms
We may update these Terms by posting a revised version and changing the effective date. If a change is material, we may provide additional notice. Changes apply prospectively from the stated effective date, except where law permits otherwise. Continued use after the effective date constitutes acceptance to the extent permitted by law.
22. Electronic Communications
You consent to receive agreements, disclosures, notices, receipts, and other communications electronically, including by email, through the Services, or at the contact information associated with your account. You are responsible for keeping your email address current and retaining copies for your records.
23. General Provisions
These Terms, together with incorporated policies and any applicable order terms, constitute the entire agreement concerning the Services. If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, financing, merger, sale, or transfer of the Services. Headings are for convenience only.
